| مقالهای را که پیش روی دارید در صدد اثبات حجیت علم قاضی در فیصله دادن به دعاوی است. اگر چه در برخی از روایات، اعتبار علم قاضی نفی شده است، اما عمده فقها در این مورد بر یکی از دو نظر ذیلاند:1. علم قاضی هم در حقوق الله و هم در حقوق الناس اعتبار دارد.2. علم قاضی تنها در حقوق الناس اعتبار دارد نه در حقوق الله.در این میان، دو قول: عدم اعتبار علم قاضی به طور مطلق و اعتبار آن در خصوص حقوق الله، از اقوال نادر به شمار میآید.نویسنده محترم با استناد به عموم و اطلاق ادله باب قضا و نیز روایات ویژه این موضوع، به نتیجهای که نظر مشهور فقهای امامیه محسوب میشود رسیدهاند و آن اینکه علم قاضی به طور مطلق حجت است و میان حقوق الله با حقوق الناس تفاوتی وجود ندارد. | ||
