| چکیده | ||
| فلسفه حقوق به بحث از معنا و مبنای الزامآور بودن قواعد حقوقی و تمایز قواعد حقوقی، اخلاقی و مذهبی میپردازد. فلسفه حقوق به نظریههای کلی درباره حقوق، قطع نظر از نظام یا شعبه خاص توجه دارد. در زبان فارسی این مباحث در ذیل عناوینی چون کلیات حقوق و نظریه کلی حقوق هم بحث میشود.در این مقاله، ابتدا ضمن تعریف واژههای مربوط، به سابقه تاریخی فلسفه حقوق اشاره شده، و جهات نیاز به تدوین فلسفه حقوق مطرح میشود و با تعیین موضوع فلسفه حقوق، مکاتب حقوقی معرفی و مبنای حقوق از دیدگاه مکتبهای تحققی و آرمانی و حقوق فطری و اسلام بیان میشود، آنگاه انتقادات وارد بر مکاتب حقوق طبیعی و پوزیتویستی به اختصار شرح داده میشود.در ادامه، مبحث مهم هدف حقوق در نظریه فردگرایان و اجتماع گرایان را طرح و به اختصار بررسی میشود. | ||
