| چکیده | ||
| امروزه دادرسی الکترونیک بهعنوان یکی از ابزارهای تحول در عدالت قضایی مطرح شده است. این شیوه نوین دادرسی در کنار مزایا و فرصتهایی که دارد، با چالشهایی نیز مواجه است که ارزیابی آنها در پرتو اصول دادرسی منصفانه، ضرورتی اجتنابناپذیر است. پژوهش حاضر با استفاده از روش توصیفیتحلیلی به مطالعه تطبیقی چالشها و فرصتهای دادرسی الکترونیک با تأکید بر اصول تضمین عدالت در فرایند دادرسی میپردازد. یکی از مهمترین فرصتهای دادرسی الکترونیک، تسهیل دسترسی افراد به عدالت از طریق کاهش هزینهها و زمان فرآیندهای قضایی است. شفافیت بیشتر، امکان ثبت کامل آرای دادگاهها و جلسات قضایی بهصورت دیجیتال و تسریع در رسیدگیها از دیگر مزایای این نظام هستند. با این حال، این تحول چالشهایی جدی نیز ایجاد کرده است که اصول دادرسی منصفانه، نظیر رعایت حق دفاع، برابری طرفین و اصل علنی بودن محاکمات را به مخاطره میاندازد. نمونههایی از این چالشها شامل محدودیت دسترسی افراد فاقد امکانات دیجیتال، احتمال نقض حریم خصوصی در بسترهای آنلاین و مسائل مرتبط با امنیت سایبری است. برخی کشورها، مانند کشورهای درحالتوسعه، با مشکلات زیرساختی و عدم آمادگی حقوقی کافی مواجه هستند که این مسائل به نوبه خود میتواند اصول دادرسی منصفانه را نقض کند. در مجموع، هرچند دادرسی الکترونیک فرصتی مهم برای بهبود کیفیت عدالت قضایی است، اما در صورت بیتوجهی به الزامات دادرسی منصفانه، ممکن است پیامدهایی منفی به همراه داشته باشد. | ||

دادرسی الکترونیک بهعنوان یکی از نوآوریهای حقوقی در عصر دیجیتال، فرصتهای قابلتوجهی را برای تحقق اصول دادرسی منصفانه فراهم کرده است. ازجمله این فرصتها میتوان به دسترسی آسانتر به عدالت، کاهش هزینههای دادرسی، تسریع در روند رسیدگی و کاهش بوروکراسی اشاره کرد. در کشورهایی مانند استرالیا و ایالاتمتحده، استفاده از فناوریهای نوین در دادرسی الکترونیک توانسته است تا حد زیادی شفافیت، کارآمدی و دسترسی به عدالت را بهبود بخشد. همچنین در کشورهای اروپایی مانند هلند و استونی، سیستمهای پیشرفته دادرسی الکترونیک با رعایت اصول محرمانگی و امنیت دادهها، الگویی موفق از انطباق فناوری با اصول دادرسی منصفانه ارائه کردهاند. با این حال، چالشهای جدی نیز در مسیر تحقق دادرسی منصفانه در بستر الکترونیک وجود دارد. یکی از مهمترین این چالشها، نابرابری در دسترسی به فناوری است که در کشورهای درحالتوسعه و فقیرتر بهوضوح دیده میشود. در این کشورها، نبود زیرساختهای مناسب فناوری اطلاعات و آموزش ناکافی کاربران میتواند منجر به نقض اصل برابری در دسترسی به عدالت شود. همچنین مسائلی نظیر امنیت سایبری، حفظ حریم خصوصی و احتمال نقض حقوق طرفین در فرآیند الکترونیکی از دیگر چالشهای اساسی است که حتی در کشورهای پیشرفته نیز بهطور کامل برطرف نشده است. با در نظر گرفتن منظر تطبیقی، در حالی که کشورهای پیشرفته توانستهاند با بهرهگیری از فناوریهای نوین، بسیاری از اصول دادرسی منصفانه را در بستر الکترونیک پیادهسازی کنند، در کشورهای درحالتوسعه، این فرآیند با موانع جدی همراه است. بنابراین، برای دستیابی به دادرسی منصفانه در بستر الکترونیک، لازم است کشورها با سرمایهگذاری در زیرساختها، ارتقای سواد دیجیتال جامعه و قضات و تدوین قوانین جامع و هماهنگ در سطح بینالمللی بر چالشها فائق آیند. تنها با این رویکرد است که میتوان ضمن بهرهگیری کامل از فرصتهای دادرسی الکترونیک، چالشهای آن را به حداقل رساند و گامی مؤثر در جهت تحقق عدالت در عصر دیجیتال و ارتقای استانداردهای دادرسی منصفانه در سطح جهانی برداشت. | ||

| Today, electronic litigation has been proposed as one of the tools for the transformation of judicial justice. Along with its advantages and opportunities, this new method of litigation also faces challenges that must be evaluated in light of the principles of fair trial. The present study, using a descriptive-analytical approach, conducts a comparative study of the challenges and opportunities of electronic litigation, emphasizing the principles of ensuring justice in the trial process. One of the most important opportunities of electronic litigation is facilitating individuals' access to justice by reducing the costs and time of judicial processes. Greater transparency, the possibility of fully recording court decisions and judicial hearings digitally, and accelerating proceedings are other advantages of this system. However, this development has also created serious challenges that jeopardize the principles of fair trial, such as respecting the right to defense, equality of parties, and the principle of public trial. Examples of these challenges include limited access for individuals without digital capabilities, the possibility of privacy violations in online platforms, and issues related to cybersecurity. Some countries, such as developing countries, face infrastructure problems and insufficient legal preparedness, which in turn can violate the principles of fair trial. Overall, although e-trial is an important opportunity to improve the quality of judicial justice, it may have negative consequences if the requirements of fair trial are ignored. | ||
