چکیده
یکی از مهم ­ترین آسیب ­های ناظر بر مخاصمات مسلحانه، به ویژه در منطقه آسیای جنوب غربی، استخدام کودکان در گروه ­ها و نیروهای مسلح و به­ کارگیری آنها در درگیری ­ها است که عملکرد گروه ­هایی مانند داعش، طالبان و ائتلاف متجاوز سعودی در یمن به وضوح آن را نشان می­ دهد. چنین رفتاری با کودکان به منزله­ ی نقض حقوقی است که در اسناد حقوق بشر و حقوق بشردوستانه برای ایشان شناسایی شده است و در حقوق بین­ الملل کیفری بر ضرورت مجازات مرتکبین تصریح گردیده است. اسناد بین­ المللی جهت تضمین حقوق کودکان در مخاصمات مسلحانه، دولت­ها را به جرم ­انگاریِ به­ خدمت گرفتن آنها در این عرصه الزام نموده ­اند. از این ­رو در نوشتار فرارو به روشی توصیفی تحلیلی موضع سه نظام حقوقی منطقه آسیای جنوب غربی، افغانستان، سوریه و عراق در مواجهه­ ی با این موضوع مورد مطالعه قرار گرفته است. یافته­ های این پژوهش نشان می­ دهد این کشورها با الهام از مقررات بین­ المللی و به ویژه اساسنامه دیوان کیفری بین ­المللی به جرم ­انگاری در این زمینه مبادرت نموده ­اند. مقررات سوریه استخدام کودکان، و قوانین افغانستان و عراق افزون بر آن، استفاده از آنها را در درگیری­ های مسلحانه به عنوان بزه توصیف نموده ­اند که در افغانستان و عراق ذیل جنایت جنگی شناسایی شده است. در مقررات کیفری افغانستان و سوریه برای این جرم مجازات­ هایی نظیر حبس و جزای نقدی تعیین شده است، اما در عراق تاکنون کیفر معینی در این زمینه تعیین نشده و بر خلاف اصل قانونمندیِ مجازات، تصمیم­ گیری در این مورد به مرجع قضایی واگذار شده استد.

تازه های تحقیق

گسترش روزافزون سوءاستفاده از کودکان در راستای به ­خدمت گرفتن آنها در مخاصمات و درگیری­ های مسلحانه­ ای که در منطقه آسیای جنوب غربی رخ می ­دهد، که به ویژه از سوی گروه­ های متجاوز و تروریستی نظیر داعش، القاعده، ارتش آزاد سوریه، طالبان و ائتلاف سعودی صورت گرفته است، ضرورت اتخاذ واکنش­ های مؤثر و قاطع را در این عرصه از سوی نظام ­های حقوقی کشورهای درگیر مضاعف می ­نماید. در این راستا استفاده از ضمانت ­اجراهای کیفری از مهم ­ترین ابزارهایی است که توسل به آن در قواعد و مقررات حقوق بین­ المللی مورد توجه ویژه قرار گرفته است، به نحوی­ که علاوه بر اساسنامه دیوان کیفری بین­ المللی که به جرم­ انگاری به ­کارگیری کودکان در مخاصمات مسلحانه تحت عنوان جنایت جنگی پرداخته است، در اسناد بین ­المللی مانند پروتکل اختیاری کنوانسیون حقوق کودک پیرامون شرکت کودکان در مخاصمات مسلحانه و اصول پاریس ناظر بر کودکانِ مرتبط با نیروها و گروه­ های مسلح نیز بر لزوم اقدام نظام­ های حقوقی ملی در جهت مقابله کیفری با این معضل تأکید شده است.

در این راستا در تحقیق حاضر موضع نظام­ های جزایی سه کشور افغانستان، سوریه و عراق را نسبت به این موضوع کاویده و به این نتایج رهنمون شده ­ایم:

  1. هر سه نظام کیفری مورد مطالعه، به ­کارگیری کودکان در مخاصمات مسلحانه را جرم ­انگاری نموده ­اند. قانون جزای افغانستان مصوب 1395ش در بند (26) ماده (339)، ماده (499) مکرر قانون مجازات سوریه مصوب 2013م و ماده (13) قانون دیوان عالی جنایی عراق مصوب 2005م متضمن این مطلب بوده که در مقررات افغانستان و عراق تحت عنوان جنایت جنگی از آن یاد شده است. نظام­ های موصوف در تقنین خود متأثر از مقررات اساسنامه دیوان کیفری بین ­المللی بوده ­اند، هر چند در این چارچوب تفاوت­ هایی میان آنها مشاهده می­شود.
  2. قوانین کیفری افغانستان و عراق، هم­سو با اساسنامه دیوان، این جرم را با دو گونه رفتار «استخدام» کودکان در گروه­ ها یا نیروهای مسلح و «استفاده» از آنها در درگیری ­های مسلحانه قابل تحقق می­ دانند؛ اما در قانون مجازات سوریه، مجرد استفاده از کودک برای درگیری مسلحانه، بدون این­که وی را به عنوان سرباز استخدام نموده باشند، جرم ­انگاری نشده است. در هر حال، استخدام و استفاده از کودکان در مخاصمات، هم حسب منصوصِ ماده (339) قانون جزای افغانستان و ماده (13) قانون دیوان عالی جنایی عراق و هم مستفاد از اطلاق ماده (488) مکرر قانون مجازات سوریه، در دو صورت اجباری و داوطلبانه قابل وقوع است.
  3. قانون جزای افغانستان هر دو نوع به­ کارگیری مستقیم و غیرمستقیم کودکان در درگیری­ های مسلحانه را جرم­ انگاری نموده است، چه حسب آن علاوه بر استفاده از کودکان برای شرکت در عملیات جنگی، هر عمل مرتبط با آن نظیر حمل یا جابجایی اسلحه، تجهیزات یا مهمات؛ نصب مواد منفجره؛ به ­کار گماردن در بخش­های بازرسی، مراقبت، شناسایی و منحرف کردن [دشمن]؛ استفاده به عنوان سپر انسانی؛ استفاده در جهت کمک و خدمت به مجرمان در هر شکلی از اشکال نیز مطمح ­نظر قرار گرفته است. اما در مقررات افغانستان و عراق، هم­سو با مفاد اساسنامه دیوان کیفری بین­ المللی، استفاده و به ­خدمت گرفتن کودکان می­ بایست در جهت مشارکت فعال در مخاصمات مسلحانه باشد.
  4. قانون جزای افغانستان و قانون دیوان عالی جنایی عراق، موافق با اساسنامه دیوان کیفری بین ­المللی، حمایت کیفری از اطفال را به افراد کمتر از پانزده سال محدود نموده­اند. در مقابل نظام کیفری سوریه در راستای الزامات ناشی از پذیرش پروتکل اختیاری کنوانسیون حقوق کودک پیرامون شرکت کودکان در مخاصمات مسلحانه، این حکم را به افراد تا هجده سال تعمیم داده است.
  5. هم­سو با اساسنامه دیوان، قانون دیوان عالی جنایی عراق به ­کارگیری کودکان را هم در نیروهای نظامی رسمی حکومتی و هم گروه­های مسلح مورد توجه قرار داده است. قانون مجازات سوریه نیز به طور مطلق به­ خدمت گیریِ کودکان را به عنوان سرباز جرم ­انگاری نموده است. با وجود این قانون جزای افغانستان مجرمانه بودنِ استخدام اطفال را فقط در نیروهای مسلح و نه گروه های مسلح مورد توجه قرار داده است.
  6. در مقررات کیفری سه کشور مورد بحث، هماهنگ با اساسنامه دیوان، «استخدام» کودک در تشکیلات مسلح به عنوان یک جرم مطلق شناخته شده است، اما رفتار «استفاده» از آنها در قوانین هر سه کشور باید به شرکت در درگیری یا عملیات جنگی منجر شود. افزون بر آن در قانون مجازات سوریه به­ کارگیری کودکان برای شرکت در عملیات مسلحانه، چنانچه به برخی نتایج معین دیگر منتج شود شکل مشددی نیز به خود می­گیرد.
  7. به­ کارگیری کودکان در مخاصمات مسلحانه در قوانین کیفری هر سه کشور جرمی عمدی قلمداد شده است که می­بایست مرتکب با سوءنیت به آن مبادرت نماید. در این راستا آگاهی مرتکب از کودک بودن قربانی، نداشتن نصاب سنّی معین، برای تحقق بزه لازم است، لکن علم وی نسبت به اوضاع و احوال واقعی که وجود درگیری مسلحانه را ثابت می­ نماید ضرورتی ندارد.
  8. مجازات به­ کارگیری کودکان در مخاصمات در قانون جزای افغانستان حبس ده تا شانزده سال است. در قانون مجازات سوریه نیز حبس موقت با اعمال شاقه از ده تا بیست سال و جزای نقدی از یک تا سه میلیون لیر سوریه به عنوان کیفر این بزه مقرر گردیده که چنانچه رفتار ارتکابی موجب از کارافتادگیِ دائم کودک، تجاوز جنسیِ به او یا دادنِ هر گونه مواد مخدر و روان گردان به وی شود مجازات به حبس ابد با اعمال شاقه تشدید خواهد شد و اگر در اثر این جرم کودک بمیرد، مرتکب اعدام خواهد شد. با وجود این در مقررات موضوعه عراق برای جرم مورد بحث مجازات خاصی تعیین نشده است. با وجود این ماده (24) قانون دیوان عالی جنایی مقرر داشته در صورتی که جرایم مطرح در این قانون در مقررات موجود عنوان مشابه نداشته باشند، دیوان حسب عوامل مختلفی نظیر خطرناکی جرم و شرایط شخصی مجرم با لحاظ سوابق قضایی و مجازات­ های محاکم کیفری بین­ المللی در این زمینه تصمیم ­گیری می ­نماید. هر چند تاکنون پرونده­ای در این زمینه در دیوان عالی جنایی عراق طرح نشده است تا بتوان نحوه ­ی برخورد کیفری مرجع مزبور را مورد بررسی قرار داد، لکن به­ طور کلی باید گفت چنین شیوه­ای که زمینه­ ی سلیقه­ گرایی قضایی را فراهم نموده مغایر اصل قانونمندی مجازات­ ها است.

One of the most important harms of armed conflict, especially in the Southwest Asia region, is the recruitment of children into groups and the armed forces and their use in conflicts which is clearly shown by the actions of groups such as ISIS, the Taliban and the Saudi-led coalition of aggression in Yemen. Such a treatment of children constitutes a violation of the rights recognized for them in human rights and humanitarian law instruments, and the International Criminal Law has reaffirmed the necessity to punish the perpetrators. International instruments have required governments to criminalize the recruitment and use of children for armed conflict in order to guarantee their rights. Therefore, in the present study, the position of three legal systems in the region of Southwest Asia i.e. Afghanistan, Syria and Iraq in dealing with this issue has been studied through a descriptive-analytical method. The findings of the research indicate that these countries, inspired by international regulations and especially the statute of the International Criminal Court, have criminalized this field. Recruitment of children and the recruitment and use of children in armed conflicts are describe as a crime in Syrian law and laws of Afghanistan and Iraq respectively which has been identified as a war crime in Afghanistan and Iraq. Criminal regulations of Afghanistan and Syria have imposed penalties such as imprisonment and fines for this crime, but in Iraq so far no specific punishment has been determined in this regard, and contrary to the principle of legality of crime and punishment, the decision in this case is left to the judiciary.
